The FELA attorneys at Peter Higgins Law were contacted by T.L. a "70 something" year old man traveling with his wife and  group of senior citizens on an Amtrak train trip from Michigan to the Ozarks in Missouri.  As the train was coming into a station in Central Illinois, our T.L. was walking inside the upper deck of the observation car when the train jerked suddenly, throwing him to the floor.  As a result, T.L. suffered a hip fracture.

At first, Amtrak denied all responsibility, claiming that the railroad accident was T.L.’s  fault. The FELA injury attorneys at Peter Higgins Law obtained witness statements from several passengers who saw the accident, and said there had been no announcement on train’s loud speaker for passengers to remain seated as the train was coming into the station.  Other witnesses said that our client was holding on to the back of a seat when the train jerked, throwing him down.

As a result of our investigation, our railroad accident lawyers were able to prove that T.L. had acted reasonably under the circumstances, and that Amtrak’s claim that he had acted negligently was unfounded.

Peter Higgins Law then negotiated a substantial confidential settlement for T.L. with the Amtrak Claims Department prior to filing of a lawsuit.
